Charleston County BMP Inspection Requirements: A Complete Guide

Quick answer: Charleston County and the City of Charleston require annual BMP inspections by a qualified professional for all properties with stormwater systems. Both jurisdictions conduct independent inspections and enforce penalties up to $1,000 per day per violation. The most common findings are sediment accumulation in ponds, outlet structure corrosion from the coastal climate, and vegetation failure in bioretention systems. Self-inspection alone won’t satisfy compliance if the county finds deficiencies during their own review.

Charleston County and the City of Charleston maintain some of the most active stormwater enforcement programs in South Carolina. If you own or manage property with stormwater best management practices (BMPs) in the Charleston area, you’re subject to inspection and maintenance requirements that carry real consequences for non-compliance. This guide explains who needs inspections, what gets inspected, how often, and what happens when deficiencies are found.

The Regulatory Picture in Charleston County

Stormwater management in the Charleston area is governed by overlapping jurisdictions. Understanding which regulations apply to your property is the first step toward compliance.

Charleston County Stormwater Program. Charleston County operates a stormwater management program under its NPDES MS4 permit issued by SCDHEC. The county’s Stormwater Management and Sediment Reduction Ordinance establishes maintenance requirements for private stormwater systems and gives the county enforcement authority over non-compliant property owners.

City of Charleston Stormwater Design Standards Manual. Properties within the City of Charleston are additionally subject to the city’s Stormwater Design Standards Manual, which establishes detailed design and maintenance criteria for BMPs. The city’s Department of Stormwater Management runs an active inspection and enforcement program for private stormwater systems. SCDHEC NPDES Permits. Both the county and the city hold MS4 permits that require post-construction stormwater management. These permits obligate the local governments to make sure private stormwater systems continue to perform as designed. That obligation gets passed to property owners through recorded maintenance agreements and local ordinance.

The Clean Water Act. The entire regulatory structure sits on the foundation of the federal Clean Water Act, which prohibits the discharge of pollutants to navigable waters without a permit. A failing stormwater BMP that allows untreated or inadequately treated runoff to reach Charleston Harbor, the Ashley River, the Cooper River, or any other water of the United States is a potential Clean Water Act violation.

Who Needs BMP Inspections

If your property has any of the following, you’re almost certainly subject to inspection requirements:

  • Detention ponds (dry ponds designed to temporarily hold stormwater and release it at a controlled rate)
  • Retention ponds (wet ponds with a permanent pool that provide water quality treatment through settling and biological processes)
  • Bioretention cells and rain gardens (vegetated depressions designed to filter stormwater through engineered soil media)
  • Bioswales (vegetated channels designed to convey and treat stormwater)
  • Permeable pavement systems (pervious concrete, porous asphalt, or permeable pavers with subsurface stone storage)
  • Manufactured treatment devices (proprietary systems like hydrodynamic separators, media filters, and cartridge systems)
  • Sand filters and infiltration basins
  • Green roofs and cisterns used for stormwater credit

The requirement applies to commercial properties, residential subdivisions, multifamily communities, institutional properties, and any other development that was required to install stormwater controls as a condition of its land disturbance or building permits.

Inspection Frequency

Annual inspections are the baseline. Both Charleston County and the City of Charleston require property owners to inspect their BMPs at least once per year. The inspection must be performed by a qualified professional who can assess whether the system is functioning as designed.

More frequent inspections may be required. Some maintenance agreements or permit conditions call for semi-annual inspections or inspections after significant storm events. Manufactured treatment devices often have manufacturer-specified inspection intervals that may be more frequent than annual. Property owners should review their specific maintenance agreement and any applicable permit conditions to determine their required inspection frequency.

The county and city conduct their own inspections too. Beyond the property owner’s obligation to self-inspect, both Charleston County and the City of Charleston conduct independent inspections of private stormwater systems. These inspections may be routine, complaint-driven, or triggered by observed failures during storm events. You can’t assume that self-reporting alone will satisfy your compliance obligations if the county or city identifies deficiencies during their own inspection.

What Gets Inspected

A thorough BMP inspection in the Charleston area evaluates the following elements:

Detention and Retention Ponds

Embankments and side slopes. Inspectors evaluate the structural integrity of all earthen embankments, looking for signs of settlement, seepage, animal burrows, erosion, and slope instability. Embankment failures pose both flooding and safety risks, which is why they’re high-priority inspection items.

Outlet structures. The outlet control structure is the engineered heart of the pond system. Inspectors assess riser pipes, orifice plates, weir walls, trash racks, and anti-vortex devices for structural integrity and proper function. Corrosion is a persistent problem in Charleston’s coastal environment, and metal components may deteriorate faster than property owners expect.

Emergency spillways. Every detention and retention pond should have an emergency spillway designed to safely pass flows that exceed the system’s design capacity. Inspectors verify that spillways are clear of obstructions, properly graded, and structurally sound.

Sediment accumulation. Inspectors measure or estimate sediment depth in the pond bottom and forebay. The City of Charleston’s standards generally call for sediment removal when accumulation reduces the design volume by a significant percentage. Forebays, which are designed to capture the heaviest sediment before it reaches the main pond, often need cleaning more frequently than the main basin.

Water quality indicators. For wet ponds, inspectors may note visible indicators of water quality issues such as algal blooms, discoloration, oil sheens, and odor. A BMP inspection isn’t a water quality sampling event, but visible indicators can signal performance problems or illicit discharges.

Vegetated BMPs

Plant coverage and health. Bioretention cells, rain gardens, and bioswales must maintain adequate vegetative cover to function as designed. Inspectors document the percentage of live vegetative cover, the presence of invasive species, and whether planted species match the approved planting plan.

Soil media condition. For bioretention systems, the engineered soil media must maintain its infiltration capacity. Signs of clogging, such as prolonged ponding after rain events, indicate that the media may need rehabilitation or replacement.

Mulch layer. Many bioretention designs include a mulch layer that must be maintained at the specified depth and replenished periodically.

Manufactured Treatment Devices

Internal components. Hydrodynamic separators, media filters, and cartridge systems have internal components that must be inspected and maintained according to manufacturer specifications. Sediment and debris accumulation, media saturation, and component wear are all assessed.

Maintenance records. For manufactured devices, inspectors may request maintenance records to verify that the system has been serviced at the manufacturer’s recommended intervals.

Permeable Pavement

Surface infiltration capacity. Permeable pavement systems must maintain their ability to infiltrate stormwater through the surface. Clogging from sediment, organic matter, and debris is the primary failure mode. Inspectors may conduct or request infiltration testing to verify performance.

Structural condition. Cracking, settling, and surface degradation reduce both the structural and hydrologic performance of permeable pavement.

Common Deficiency Findings

The most frequently cited deficiencies in Charleston County BMP inspections include:

  1. Sediment accumulation exceeding maintenance thresholds. This remains the most common and most consequential finding. Ponds that have never been dredged since construction are surprisingly common, and the resulting capacity loss can be dramatic.

  2. Outlet structure deterioration. Charleston’s salt-influenced coastal climate accelerates corrosion of metal components. Riser pipes, orifice plates, and trash racks are particularly vulnerable.   3. Bank erosion and embankment issues. Tidal influence, wave action from wind and stormwater inflow, wildlife activity, and improper landscaping maintenance all contribute to bank erosion. Left unaddressed, bank erosion can progress to embankment instability, which is both a safety hazard and a regulatory emergency.

  4. Vegetation failure in bioretention systems. Bioretention cells and rain gardens require active horticultural management. In Charleston’s climate, systems can become overgrown with invasive species within months of being neglected. Planted vegetation can also die from drought stress, flooding, or improper species selection.

  5. Clogged permeable pavement. Without regular vacuum sweeping and maintenance, permeable pavement systems lose their infiltration capacity. Once severely clogged, rehabilitation can be expensive and may require surface removal and replacement.

  6. Missing or non-functional inlet and outlet protection. Riprap, energy dissipaters, and erosion control measures at pipe inlets and outlets must be maintained to prevent scour and erosion.

Penalty Escalation

Both Charleston County and the City of Charleston follow graduated enforcement processes, but both have the authority to impose significant penalties for non-compliance.

Initial notification. The enforcement process typically begins with a written notice identifying deficiencies and requesting corrective action within a specified timeframe. This notice may take the form of an inspection report with required actions, a courtesy letter, or a formal Notice of Violation depending on the severity of the findings.

Notice of Violation. If the initial notification doesn’t produce results, a formal NOV is issued. The NOV specifies the violations, required corrective actions, and a compliance deadline. Deadlines typically range from 30 to 90 days for routine maintenance items, with shorter deadlines for conditions that pose immediate risks.

Civil penalties. Non-compliance beyond the NOV deadline can trigger civil penalties. Under South Carolina law and local ordinance, stormwater violations can be penalized at rates up to $1,000 per day per violation. The City of Charleston has been particularly active in pursuing penalties for chronic non-compliance.

Stop work orders and permit holds. For properties with active development or renovation, the county or city may issue stop work orders or withhold permits until stormwater violations are resolved.

Forced compliance. Both jurisdictions have the authority to enter non-compliant properties, perform necessary maintenance, and charge the costs back to the property owner. These costs are typically higher than what the property owner would have paid to do the work themselves, and they may be pursued through liens.

Maintenance Agreement Basics

Every property with permitted BMPs in Charleston County has a recorded maintenance agreement that establishes the property owner’s obligations. Key elements include:

  • Identification of responsible party. The agreement names the party responsible for maintenance, which is the current property owner. Responsibility transfers automatically with ownership.
  • Description of BMPs. The agreement identifies all stormwater systems on the property and their design parameters.
  • Maintenance standards. The agreement establishes the specific maintenance activities required for each BMP type and the performance standards they must meet.
  • Access provisions. The county or city is granted the right to access the property for inspection and, if necessary, to perform maintenance at the owner’s expense.
  • Enforcement provisions. The agreement references the penalties and enforcement mechanisms available to the local government.

Build a maintenance calendar. Schedule routine maintenance activities throughout the year. HOA boards should make sure their reserve studies include stormwater capital needs. Property managers should communicate these long-term costs to ownership early and often.

Document everything. Every inspection, every maintenance activity, every repair should be documented with dates, descriptions, photographs, and costs. This documentation is your evidence of compliance if the county or city ever questions your maintenance practices.

Don’t modify BMPs without approval. Any change to a stormwater system, whether it involves grading, piping, vegetation removal, or outlet modification, requires approval from the permitting jurisdiction. Unauthorized modifications can result in violations and may require you to restore the system to its original design at your expense.
